ہم سے عبداللہ بن عبدالوہاب نے بیان کیا ، انہوں نے کہا ہم سے خالد بن الحارث نے بیان کیا ، انہوں نے کہا ہم سے سفیان نے بیان کیا ، ان سے ابوحصین نے ، انہوں نے کہا کہ میں نے عمیر بن سعید نخعی سے سنا ، کہا کہ میں نے علی بن ابی طالب رضی اللہ عنہ سے سنا ، انہوں نے کہا کہ

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ عَبْدِ الْوَهَّابِ، حَدَّثَنَا خَالِدُ بْنُ الْحَارِثِ، حَدَّثَنَا سُفْيَانُ، حَدَّثَنَا أَبُو حَصِينٍ، سَمِعْتُ عُمَيْرَ بْنَ سَعِيدٍ النَّخَعِيَّ، قَالَ سَمِعْتُ عَلِيَّ بْنَ أَبِي طَالِبٍ ـ رضى الله عنه ـ قَالَ مَا كُنْتُ لأُقِيمَ حَدًّا عَلَى أَحَدٍ فَيَمُوتَ، فَأَجِدَ فِي نَفْسِي، إِلاَّ صَاحِبَ الْخَمْرِ، فَإِنَّهُ لَوْ مَاتَ وَدَيْتُهُ، وَذَلِكَ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم لَمْ يَسُنَّهُ‏.‏

Urdu Translation

اردو

میں نہیں پسندکروں گا کہ حد میں کسی کو ایسی سزا دوں کہ وہ مر جائے اور پھر مجھے اس کا رنج ہو ، سوا شرابی کے کہ اگر وہ مر جائے تو میں اس کی دیت ادا کر دوں گا کیونکہ رسول اللہ صلی اللہ علیہ وسلم نے اس کی کوئی حد مقرر نہیں کی تھی ۔

English Translation

Meaning of the narration

I would not feel sorry for one who dies because of receiving a legal punishment, except the drunk, for if he should die (when being punished), I would give blood money to his family because no fixed punishment has been ordered by Allah's Messenger (ﷺ) for the drunk.
