Narrated by Al-Mughira bin Shu'ba رضی اللہ عنہ reported:

مجھ سے محمد بن رافع نے بیان کیا، ہم سے یحییٰ بن آدم نے بیان کیا,مفضل نے منصور سے ، انہوں نے ابراہیم سے ، انہوں نے عبید بن نضیلہ سے اور انہوں نے حضرت مغیرہ بن شعبہ رضی اللہ عنہ سے روایت کی ، انہوں نے کہا

وحَدَّثَنِي مُحَمَّدُ بْنُ رَافِعٍ، حَدَّثَنَا يَحْيَى بْنُ آدَمَ، حَدَّثَنَا مُفَضَّلٌ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، عَنْ عُبَيْدِ بْنِ نُضَيْلَةَ، عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ، أَنَّ امْرَأَةً قَتَلَتْ ضَرَّتَهَا بِعَمُودِ فُسْطَاطٍ، فَأُتِيَ فِيهِ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَقَضَى عَلَى عَاقِلَتِهَا بِالدِّيَةِ، وَكَانَتْ حَامِلًا، فَقَضَى فِي الْجَنِينِ بِغُرَّةٍ، فَقَالَ بَعْضُ عَصَبَتِهَا: أَنَدِي مَنْ لَا طَعِمَ، وَلَا شَرِبَ، وَلَا صَاحَ فَاسْتَهَلَّ، وَمِثْلُ ذَلِكَ يُطَلُّ، قَالَ، فَقَالَ: «سَجْعٌ كَسَجْعِ الْأَعْرَابِ.

Urdu Translation

اردو

ایک عورت نے اپنی سوتن کو خیمے کی لکڑی سے قتل کر دیا ، اس ( معاملے ) کو رسول اللہ صلی اللہ علیہ وسلم کے پاس لایا گیا تو آپ نے اس عورت کے عاقلہ پر دیت عائد ہونے کا فیصلہ فرمایا اور چونکہ وہ حاملہ ( بھی ) تھی تو آپ نے پیٹ کے بچے کے بدلے میں ایک غلام ( بطور تاوان دیے جانے ) کا فیصلہ کیا ، اس پر اس کے عصبہ ( جدی مرد رشتہ داروں ) میں سے کسی نے کہا :کیا ہم اس کی دیت دیں جس نے نہ کھایا ، نہ پیا ، نہ چیخا ، نہ چلایا ، اس طرح کا ( خون ) تو رائیگاں ہوتا ہے ، کہا : تو آپ صلی اللہ علیہ وسلم نے فرمایا : کیا بدوؤں کی سجع جیسی سجع ہے؟

English Translation

Meaning of the narration

A woman killed her fellow-wife with a tent-pole. Her case was brought to Allah's Messenger ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌), and he gave judgment that blood-wit should be paid by the relatives (of the offender) on the father's side. And as she was pregnant, he decided regarding her unborn child that a male or a female slave of good quality be given. Some of her offender's) relatives said: Should we make compensation for one who never ate, nor drank, nor made any noise, who was like a nonentity? Thereupon Allah's Messenger ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌) said: He was talking rhymed phrases like the rhymed phrases of desert Arabs.
