أَخْبَرَنِي زِيَادُ بْنُ أَيُّوبَ، قَالَ: حَدَّثَنَا ابْنُ عُلَيَّةَ، قَالَ: أَنْبَأَنَا أَيُّوبُ، عَنْ يَعْلَى بْنِ حَكِيمٍ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، عَنْرَافِعِ بْنِ خَدِيجٍ، قَالَ: كُنَّا نُحَاقِلُ بِالْأَرْضِ عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَنُكْرِيهَا بِالثُّلُثِ وَالرُّبُعِ وَالطَّعَامِ الْمُسَمَّى، فَجَاءَ ذَاتَ يَوْمٍ رَجُلٌ مِنْ عُمُومَتِي، فَقَالَ: نَهَانِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ أَمْرٍ كَانَ لَنَا نَافِعًا وَطَوَاعِيَةُ اللَّهِ وَرَسُولِهِ أَنْفَعُ لَنَا، نَهَانَا أَنْ نُحَاقِلَ بِالْأَرْضِ، وَنُكْرِيَهَا بِالثُّلُثِ وَالرُّبُعِ وَالطَّعَامِ الْمُسَمَّى، وَأَمَرَ رَبَّ الْأَرْضِ أَنْ يَزْرَعَهَا، أَوْ يُزْرِعَهَا، وَكَرِهَ كِرَاءَهَا . وَمَا سِوَى ذَلِكَ أَيُّوبُ لَمْ يَسْمَعْهُ مِنْ يَعْلَى.
English Translation
It was narrated that Rafi' bin Khadij said: At the time of the Messenger of Allah we used to lease land on the basis of Al-Muhaqalah, so we would lease it in return for one-third or one-quarter of the yield, or a specified amount of food (produce). One day, a man among my paternal uncles came and said 'The Messenger of Allah has forbidden me to do something that was beneficial for us, but obedience to Allah and His Messenger is more beneficial for us. He has forbidden us to lease land on the basis of Al-Muhaqalah and to lease it in return for one-third or one-quarter of the yield, and for a specified amount of food (produce). And he commanded the landowner to cultivate it (himself) or to give it to someone else to cultivate. He did not like leasing it or anything else.'
Urdu Translation
ہم رسول اللہ صلی اللہ علیہ وسلم کے زمانے میں زمین میں بٹائی کا معاملہ کرتے تھے، ہم اسے تہائی یا چوتھائی یا غلہ کی متعینہ مقدار کے عوض کرائیے پر دیتے تھے۔ تو ایک دن میرے ایک چچا آئے اور انہوں نے کہا: مجھے رسول اللہ صلی اللہ علیہ وسلم نے ایک ایسے معاملے سے روک دیا جو ہمارے لیے نفع بخش اور مفید تھا، لیکن اللہ اور اس کے رسول کی اطاعت ہمارے لیے زیادہ مفید اور نفع بخش ہے، آپ نے ہمیں زمین میں بٹائی کا معاملہ کر کے انہیں تہائی اور چوتھائی یا متعینہ مقدار کے غلے کے بدلے کرائیے پر دینے سے منع کیا ہے۔ اور زمین کے مالک کو حکم دیا ہے کہ وہ اس میں کھیتی کرے، یا اس میں ( بلا کرایہ لیے ) کھیتی کرائے اور اسے کرائے پر اٹھانا یا اس کے علاوہ جو صورتیں ہوں انہیں ناپسند فرمایا۔ ایوب نے اس حدیث کو یعلیٰ سے نہیں سنا ہے، ( بلکہ بذریعہ کتابت روایت کی ہے جیسا کہ اگلی سند سے ظاہر ہے ) ۔

It was narrated from Al-Hasan that he disliked to hire a man without telling him what his wages would be.
أَخْبَرَنَا مُحَمَّدُ بْنُ حَاتِمٍ، قَالَ: أَنْبَأَنَا حِبَّانُ، قَالَ: أَنْبَأَنَا عَبْدُ اللَّهِ، عَنْ جَرِيرِ بْنِ حَازِمٍ، عَنْ حَمَّادٍ هُوَ ابْنُ أَبِي سُلَيْمَانَأَنَّهُ سُئِلَ عَنْ: رَجُلٍ اسْتَأْجَرَ أَجِيرًا عَلَى طَعَامِهِ ؟ قَالَ: لَا حَتَّى تُعْلِمَهُ .
It was narrated from Hammad -Ibn Abi Sulaiman- that he was asked about a man who hired a worker in return for food and he said: No, not until he tells him (what his wages will be).
أَخْبَرَنَا مُحَمَّدٌ، قَالَ: حَدَّثَنَا حِبَّانُ، قَالَ: أَنْبَأَنَا عَبْدُ اللَّهِ، عَنْ مَعْمَرٍ، عَنْ حَمَّادٍ، وَقَتَادَةَ: في رجل قَالَ لِرَجُلٍ: أَسْتَكْرِي مِنْكَ إِلَى مَكَّةَ بِكَذَا وَكَذَا، فَإِنْ سِرْتُ شَهْرًا أَوْ كَذَا وَكَذَا شَيْئًا سَمَّاهُ فَلَكَ زِيَادَةُ كَذَا وَكَذَا. فَلَمْ يَرَيَا بِهِ بَأْسًا، وَكَرِهَا أَنْ يَقُولَ: أَسْتَكْرِي مِنْكَ بِكَذَا وَكَذَا، فَإِنْ سِرْتُ أَكْثَرَ مِنْ شَهْرٍ نَقَصْتُ مِنْ كِرَائِكَ كَذَا وَكَذَا .
It was narrated from Hammad and Qatadah, concerning a man who said to another man: I will lease (something) from you until I reach Makkah for such and such a payment, and if I travel for a month or such and such -something that he named- I will give you such and such in addition. They did not see anything wrong with that, but they did not like it if he said: If I travel for more than a month I will deduct such and such from your lease.
